1. Scope of application

The present Terms and Conditions of Sale apply, without restriction and reservation, to all sales concluded by Arcana Center with consumers and non-professional buyers wishing to acquire the products offered for sale by the Seller on the website:

These terms and conditions are subject to french law. This applies to rules of substantive matters and procedure.

They specify the conditions of order, payment, delivery and management of eventual Product returns by the Customers. The Products for sale on the website are health and well-being products, excluding medicines.

The main characteristics of the products and, specifically, their ingredients and instructions for use are presented on the website. The Customer must read them before placing an order. The choice and purchase of a product is the sole responsibility of the Customer. The photographs and graphics on the website represent the products as faithfully as possible. However, colours may vary from one device to another. The customer must read the description of each product carefully to understand their properties and essential characteristics.

The proposed products are subject to availability.

The Customer must declare that they have read the Terms and Conditions of Sale and must accept them by ticking the box provided for this purpose before proceeding with the online ordering process. The Customer’s validation of the Order shall constitute acceptance of the Terms and Conditions of Sale without any restriction or reservation. Any Order placed on the website shall constitute the formation of a contract between the parties, i.e., the Customer and the Seller.

The Products presented on the website are offered for sale by mail order in the following territories: France, Belgium, Luxembour, Switzerland Germany, Canada and Australia. In the event of an Order being sent to any country other than mainland France or to a foreign country, the Customer is the importer of the Product(s). For all Products shipped outside the European Union and French overseas departments and territories, the price will automatically be calculated on the invoice excluding tax. Customs duties or any other local taxes or import duties or state taxes may be payable. They will be charged to and remain the sole responsibility of the Customer.

2. Food supplements

The food supplements offered by the Seller are created by a team of experts (doctors, pharmacists, nutritionists) based on scientific studies to offer the best active ingredients and the most suitable formats to promote optimal bioavailability. The dosages of the natural active ingredients are those used in benchmark scientific studies to ensure high efficacy and perfect safety.

3. Manufacturing and compliance.

The goods remain the property of Arcana Center until full payment has been received. The present terms and conditions of sale as well as the contracts concluded in application are governed by French law. The place of jurisdiction in case of dispute France.

4. Orders

The Customer selects the Products they wish to order on the website.

The contractual information is presented in French and shall be confirmed at the latest when the Customer validates the Order. A choice of different languages is offered.

The Product offers are valid for as long as they are visible on the website and while stocks last.

The sale will be considered final only after validation of the Customer’s payment.

The registration of an Order on the website is completed when the Customer accepts the General Terms and Conditions by ticking the box provided for this purpose and validates the Order. The Customer may check the details of the Order, its total price and correct any errors before confirming its acceptance. This validation implies acceptance of the entirety of the General Terms and Conditions and constitutes proof of the sales contract.

5. Prices

The Products shall be supplied at the prices shown on the website when the Order is registered by the Seller. Prices are expressed in euros, including VAT.

The prices take into account any discounts granted by the Seller on the website.

The payment charged to the Customer corresponds to the total amount of the purchase, including expenses.

The Seller will issue and send an invoice to the Customer by e-mail upon receipt of payment.

6. Terms of payment

The price is payable in full on the day the Order is placed, by secure payment, according to the following terms and conditions:

- by credit card: Visa, MasterCard, American Express.

Any payment made by the Customer shall not be considered final until the Seller has received the amounts due.

Furthermore, the Seller reserves the right, in the event of failure to comply with the above terms of payment, to suspend or cancel the delivery of any outstanding Orders placed by the Customer.

 

7. Deliveries (outside switzerland)

The customer is solely responsible for any necessary steps necessary for the importation of the goods on their territory in accordance with the law in force (outside Switzerland). The customer must certify that they are of legal age and has the right and authority to order the goods. They must also guarantee to have previously informed themselves to ensure that the order does not violate any provision of the law in force in the country of delivery or residence of the buyer and that all information provided is accurate.
Any customs duties (customs clearance and local VAT) must be paid by the customer.

 

The Products will be dispatched within 5 days of the Order date to the delivery address indicated by the Client. The Seller shall not be held responsible for any delays caused by the carrier.

- The Seller undertakes to make every effort to deliver the Products within the time limits indicated at the time of the Order. However, these delivery times are given as an indication only. If the order cannot be shipped within 5 days, a new delivery time will be communicated to the client within 72 hours following the order.

- Upon delivery, the Client is required to check the condition of the Products. The Customer has 24 hours from the date of delivery to express any reservations or claims for non-conformity or apparent defects of the Products delivered (for example, damaged packaging, already opened etc...), and must provide all the related supporting documents: invoices and photos.

 After this period and if these requirements are not respected, the Products shall be deemed to be in conformity and free of any apparent defect and no claim may be validly accepted by the Seller.

The Seller shall reimburse or replace as soon as possible and at its own expense, the Products whose conformity defects or apparent or hidden defects have been duly proven by the Customer.

All deadlines mentioned in the Terms and Conditions are given in working days.

9. Right of withdrawal

The Products presented on the website do not systematically benefit from a right of withdrawal, particularly if they have been unsealed by the Customer.

In accordance with the legal provisions in force, the Customer has a period of fourteen days from receipt of the Product likely to be retracted to exercise their right of withdrawal from the Seller, justifying, if possible, the reason, without having to pay any penalty, for the purpose of exchange or refund, provided that the Products have not been unsealed and are returned in their original packaging and are in perfect condition.

The returns are to be made at the expense of the Customer in their original complete state (packaging, accessories, instructions etc...) allowing them to be put back on the market in new condition, accompanied by the purchase invoice and the withdrawal form to : Arcana Center CP 149- 1225 CHENE-BOURG -SWITZERLAND

Unsealed, damaged, soiled or incomplete Products cannot be returned.

The right of withdrawal must clearly express the wish to withdraw within the deadline.

If the right of withdrawal is exercised within the above-mentioned period, the price of the Product(s) and the delivery costs will be reimbursed, however the return costs will be at the Customer’s expense.

The exchange (subject to availability) or refund will be made within 14 days of the Seller receiving the Products returned by the Customer under the conditions set out in this article.

 

10. «Satisfied or Refunded» guarantee

The Customer benefits from a «Satisfied or Refunded» guarantee which allows them to obtain, within 30 days of purchase of the Product, its refund or exchange if they are not satisfied with the result.

The Products (even opened but not empty) must be returned to the following address

- Receive credit for your next order.

- Carry out an exchange.

- Request a refund.

The Customer must ensure that the returned Products can be tracked during transit and are delivered to the Seller against signature. Indeed, only Products returned to the Seller may give rise to the implementation of the present guarantee.

Upon receipt of the Products, the Seller will reimburse only the Products and not the shipping costs.

This guarantee is limited to one Order per year.

 

11. Personal data

Right of access, rectification and opposition :

Any data you provide us with is used to process your orders.
In accordance with the French law relating to data processing, files and the conditions of storing data, you have the right to rectify, consult, modify and delete any data you have communicated to us. This right must be exercised by:

All information collected on the website is recorded in a computer file kept by the Seller for the purpose of processing the Order. It shall be kept for a period of 3 years before being archived for a period equal to the legal time limit for any actions relating to the Order.

Requests made in this way must be accompanied by a copy of an identity document to be taken into account by the Seller.

 

12. Intellectual Property

The content of the website is the property of the Seller and is protected by intellectual property laws.

Any total or partial reproduction of this content is strictly forbidden and constitutes an infringement of copyright.

Furthermore, the Seller retains all intellectual property rights to the photographs, presentations, studies, drawings, models, prototypes, etc., produced (even at the request of the Customer) for the purpose of providing Services to the Customer. The Customer is therefore prohibited from reproducing or exploiting these studies, drawings, models and prototypes, etc., without the express, written and prior authorisation of the Seller, who may then agree to this in return for financial compensation.

 

13. Modifications to the Terms and Conditions

The Seller may at any time unilaterally modify the Terms and Conditions, which the Customer expressly acknowledges and accepts.

In the event of such a change, the terms and conditions applicable shall remain those in force on the date of the Order.

The Seller reserves the right to suspend or stop the website at any time. In the event that the website is definitively discontinued, the Seller undertakes to fulfil all Orders in progress until their completion.

 

14. Governing law - Language

The Terms and Conditions and the transactions arising from them are governed by and subject to French law.

The Terms and Conditions are written in French. In the event that they are translated into one or more foreign languages, the French text shall be the only valid and admissible version in the event of a dispute.

 

15. Litigation

In the event of any dispute about the Order, the Customer shall first contact the Seller by any of the means set out above. All disputes arising from the purchase and sale of transactions concluded in compliance with the General Terms and Conditions, concerning the validity, interpretation, performance, termination, and consequences thereof, which cannot be resolved, shall be submitted to the competent courts under the conditions of common law.
